The App is a technological solution designed to provide users with access to other users for the purposes of social interaction, gaming, dating, matchmaking and participation in dating-related features. The online self-service system is intended to be used by users to facilitate introductions, communication and engagement.
2. Acceptance of Terms
By accessing and/or using the App and related services, you agree to these Terms and Conditions, which include our Privacy Policy (“Terms”). In these Terms, 'us', 'we' and 'our' means Rainbow Dating and our related bodies corporate.
Rainbow Dating has the right to modify the policies, conditions, payments, fees and these Terms at any time. By using the App, you acknowledge that any interaction, communication, meeting, arrangement or relationship formed through the App is solely between you and the other user, and that Rainbow Dating is not a party to any such interaction, communication, meeting, arrangement or relationship.
3. Registration
You may be required to register an account through Rainbow Dating (“Account”) before you can fully utilise the App. An Account holder warrants that any information provided in the course of completing the registration process will always be accurate, correct and up to date.
To create an account, you must:
(a) agree and warrant to use the App in accordance with these Terms.
(b)be at least 18 years old;
(c) possess the legal right and ability to enter into a legally binding agreement; and
(d) have the authority to represent a third party (if applicable) and bind the third party to the Terms.
We reserve the right to reject a registration or remove a profile from the App at any time at our absolute discretion.
4. Your acknowledgement
The User understands, confirms and acknowledges that:
(a) the email address, mobile number and any other contact details provided by the User are true, accurate and current, and Rainbow Dating is not liable for any consequences arising from the User’s failure to verify their Account details or from the provision of inaccurate or incomplete contact information.
(b) any personal information, profile information, photographs, verification information and other content provided by the User is true, accurate, current and not misleading.
(c) any identification documents or other verification materials provided by the User are authentic, valid and belong to the User.
(d) the User is solely responsible for complying with all laws applicable to their use of the App.
(e) any complaint, report or dispute made by or against the User will be managed in accordance with Rainbow Dating’s dispute resolution, moderation, safety and reporting policies, and certain conduct, including failure to attend an arranged meeting, misuse of the App, abusive conduct, misleading conduct, or breach of the Terms, may result in suspension of features, removal of content, withholding of credits or benefits, or termination of the User’s Account.
(f) Rainbow Dating reserves the right, in its absolute discretion, to remove, suspend, restrict, refuse to publish or cease to display any profile, content, communication, feature access or Account.
(g) Users must comply with these Terms and any policies, community guidelines, safety rules or other platform requirements published by Rainbow Dating from time to time. Any reported or suspected breach may result in immediate suspension, restriction or removal from the App.
(h) Users are encouraged to communicate promptly and respectfully with other users regarding cancellations, delays, safety concerns or other issues in order to minimise disputes and misunderstandings.
5. Accuracy, completeness and timeliness of information
Images, profiles, features and other content on the App are for illustrative and informational purposes only. Third parties, including users, may be permitted to post content on the App.
Rainbow Dating does not endorse or approve any user, profile or content on the App. It is your sole responsibility to determine whether any other user, interaction, communication, meeting or arrangement is suitable, appropriate or safe for you.
While Rainbow Dating uses reasonable efforts to ensure the accuracy and completeness of the information on the App, to the extent permitted by law, including the Australian Consumer Law (ACL), Rainbow Dating makes no warranty regarding the accuracy, completeness, reliability or currency of any information on the App.
Rainbow Dating is not liable to you or anyone else for any interference with, or damage to, your device, software or systems arising in connection with your use of the App or any linked website or application. You must take your own precautions to ensure that anything you access or download from the App is free of viruses, malware or other harmful code.
Rainbow Dating may, from time to time and without notice, change or add to the App, its features, its content or these Terms. Rainbow Dating does not undertake to keep the App updated and is not liable to you or anyone else if the App contains errors or if any information is inaccurate or out of date.
To the maximum extent permitted by law, you agree that Rainbow Dating is not responsible for any loss or damage caused directly or indirectly as a result of any interaction, communication, meeting, arrangement, event or other activity facilitated through the App. You must take your own precautions to ensure that whatever you select for your use from the App is free of viruses or anything else (such as worms or Trojan horses) that may interfere with or damage the operations of your computer systems.
We may, from time to time and without notice, change or add to the App (including the Terms) or the information, products or services described in it. However, we do not undertake to keep the App updated. We are not liable to you or anyone else if errors occur in the information on the App or if that information is not up-to-date.
You agree that you will not hold us responsible for any damage caused directly or indirectly as a result of the services which were facilitated through the App.
6. Self Service
(a) The App’s online self-service system enables users to connect, communicate, participate in dating game features and, where applicable, purchase or access subscriptions, premium features, bookings, events or other services available through the App. Rainbow Dating provides the technological infrastructure for those interactions and transactions and is not a party to any arrangement, communication, meeting or relationship between users.
(b) Users must ensure that all information submitted through any form, profile, request, preference setting, booking flow or other function of the App is sufficiently detailed, accurate, current and complete.
(c) Rainbow Dating may apply and collect service fees, booking fees, transaction fees, subscription fees or other charges in respect of transactions conducted through the App.
(d) Unless otherwise expressly stated, any entitlement to payment, credit, access or other benefit associated with a paid feature, event, booking or experience arises only in accordance with Rainbow Dating’s payment terms and applicable policy settings.
(e) The scope of any booking, arrangement, event or other engagement facilitated through the App is limited to the terms expressly recorded through the App, unless amended by a further arrangement made in accordance with these Terms.
(f) Where Rainbow Dating requires a transaction or arrangement to be processed through the App, users must not circumvent the App’s payment or booking processes.
7. Your Obligations
Each user must:
(a) comply with all applicable laws, regulations, standards and these Terms in connection with their access to and use of the App;
(b) refrain from any conduct that is unlawful, improper, abusive, threatening, harmful, unsafe or otherwise unacceptable as determined by Rainbow Dating acting reasonably;
(c) maintain the confidentiality and security of all login credentials and Account information, and accept responsibility for all activity occurring through their Account;
(d) notify Rainbow Dating immediately upon becoming aware of any unauthorised Account access, suspected compromise of credentials or other security incident relating to the App;
(e) not use the App to post, transmit or engage in conduct that is defamatory, harassing, abusive, threatening, coercive, discriminatory, deceptive, sexually exploitative, offensive or otherwise harmful;
(f) not interfere with, damage, disable, overburden, impair or compromise the operation, integrity or security of the App or any related systems or networks;
(g) not copy, scrape, reproduce, distribute, modify, reverse engineer, exploit or otherwise use App content, data or functionality except as expressly permitted by Rainbow Dating or by law;
(h) not use the App for any unauthorised commercial purpose, including advertising, lead generation, solicitation or promotion, except to the extent expressly authorised by Rainbow Dating;
(i) not use the App for any illegal, fraudulent or misleading activity;
(j) acknowledge that Rainbow Dating may remove advertisements, affiliate material, spam, solicitations or other prohibited content without notice;
(k) warrant that you have not been convicted of any sexual offence, any offence involving violence against a person, or any offence involving the abuse, exploitation or endangerment of children or vulnerable persons;
(l) warrant that you are not subject to any sex offender registration requirement in any jurisdiction;
(m) use the App honestly, responsibly and in good faith.
(n) not create a false identity, impersonate another person, or misrepresent your age, relationship status, intentions or personal characteristics;
(o) not request, send or publish intimate images, explicit content or sensitive personal information in breach of these Terms or any applicable law;
(p) not use the App to engage in catfishing, romance scams, financial exploitation, coercive conduct or any other deceptive or manipulative behaviour; or
(q) not use the App to contact minors or any person who is not legally permitted to use the App.
Rainbow Dating may, at any time and in its absolute discretion, refuse registration, reject or remove a profile, suspend an Account, or restrict access to any part of the App, with or without notice.
8. Payments
(a) The User must pay all applicable fees, premium features, bookings, events, services or other paid features offered through the App (the Fee).
(b) The User must provide valid and current credit card or debit card details through the App and authorises Rainbow Dating, and any third-party payment processor engaged by it, to charge that payment method for all Fees and other amounts payable under these Terms.
(c) In using the App or making any payment, the User warrants that they have read, understood and agree to be bound by the terms and conditions of any applicable third-party payment provider.
(d) The User warrants that they are authorised to use the nominated payment method and will ensure that sufficient funds or credit are available when payment is processed.
(e) Rainbow Dating may issue invoices or receipts electronically after each successful payment.
(f) If any payment is declined, reversed or subject to chargeback, Rainbow Dating may suspend or terminate access to the relevant paid feature or to the App until all outstanding amounts are paid.
(g) Fees are as set out on the App. Rainbow Dating may vary Fees, billing arrangements and payment policies from time to time.
(h) Billing disputes must be notified within 14 days of the relevant invoice or receipt. Rainbow Dating will investigate and act reasonably to resolve the dispute.
9. Non Solicitation
(a) Where the App facilitates any paid booking, event, premium interaction or other commercial arrangement, users must complete that transaction through the App and must not seek to avoid Rainbow Dating’s Fees by arranging payment outside the App.
(b) Users must not solicit or encourage another user to move any paid transaction off-platform where that transaction arose from a connection or introduction made through the App.
(c) Each User acknowledges that this clause is reasonably necessary to protect Rainbow Dating’s legitimate business interests.
10. Promotions and competitions
For certain campaigns, promotions or contests, additional terms and conditions may apply. If you want to participate in such a campaign, promotion or contest, you agree to the relevant terms and conditions applicable to that campaign, promotion or contest. In case of any inconsistency between such terms and conditions and these Terms, those terms and conditions will prevail.
11. Fitness for Purpose
(a) To the maximum extent permitted by law, you agree that you do not rely on our skill or judgement in relation to the suitability of any services for a particular purpose.
(b) Any recommendation, information or assistance provided by us is provided without any liability whatsoever.
(c) The content of, or any opinion expressed in any post does not represent the views of Rainbow Dating in respect of the content of that post. The fact that a post has not been removed by Rainbow Dating is not an endorsement of its content.
(d) You agree and acknowledge that Rainbow Dating provides a platform only, that acts as a forum for venue for the online connection and does not verify or approve of the users.
(e) By using the App, all users agree and acknowledge that Rainbow Dating accepts no responsibility for the accuracy of any post or other information posted by a user to the App and all users release and forever hold harmless Rainbow Dating from any liability in respect of the inaccuracy of any post, or the information contained therein, howsoever arising or howsoever caused.
(f) Views expressed by anyone you connect with through the App are not endorsed by Rainbow Dating.
(g) The information, including statements, opinions, documents and materials contained on the App is for general information purposes only. Rainbow Dating does not take into account your specific needs, objectives or circumstances. Any reliance you place on the App is at your own risk.
(h) To the maximum extent permitted by law, Rainbow Dating excludes all liability for any loss or damage of any kind (including special, indirect or consequential loss) arising out of or in connection with the App except to the extent that the loss or damage is directly caused by Rainbow Dating’ fraud or wilful misconduct.
12. The relationship between the Users and Rainbow Dating
(a) The App is a platform that allows users to connect with other users for dating, social interaction and related features.
(b) Any interaction, communication, meeting, arrangement or relationship formed through the App is between the relevant users only. Rainbow Dating is not a party to any such arrangement.
(c) Rainbow Dating does not employ, engage or act as agent for any user and does not supervise or control user interactions.
(d) Each user has complete discretion whether to interact or engage with another user.
(e) Rainbow Dating does not guarantee matches, compatibility or outcomes.
(f) Each user is responsible for their own conduct, safety and decisions, including in relation to offline meetings and any arrangements made with other users.
(g) To the maximum extent permitted by law, Rainbow Dating is not liable for any loss, damage or claim arising from user interactions, arrangements or conduct.
13. Collection Notice
We collect personal information about you in order to respond to your enquiry or provide you with further information and for purposes otherwise set out in our Privacy Policy.
We may disclose that information to third parties that help us deliver our services (including information technology suppliers, communication suppliers and our business partners) or as required by law. If you do not provide this information, we may not be able to provide all of our services to you. We may also disclose your personal information to recipients that are located outside of Australia.

Rainbow Dating may contain links to Apps operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked Apps and have no control over or rights in those linked Apps.
15. Rainbow Dating Dispute Resolution Policy
(a) Users may submit a complaint, report or dispute about another user through the App, including details of the issue and any supporting evidence.
(b) Rainbow Dating may notify the other user and investigate the matter by reviewing relevant information and requesting further details from either party.
(c) Rainbow Dating may, but is not required to, conduct a resolution process or meeting by phone, video conference or written exchange.
(d) After reviewing the matter, Rainbow Dating may decide what action to take, including warnings, content removal, feature restrictions, suspension, termination, cancellation of paid features, or refund and credit decisions where applicable.
(e) Rainbow Dating may keep records of complaints and outcomes in accordance with its policies.
16. Intellectual property rights
Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in the App and in all of the material (including all text, graphics, logos, audio and software) made available on App (Content).
Your use of the App and use of and access to any Content does not grant or transfer any rights, title or interest to you in relation to the Content. However, we do grant you a licence to access the App and view the Content on the terms and conditions set out in these Terms and, where Applicable, as expressly authorised by us and/or our third party licensors.
Users warrant that they hold all intellectual property in any post that they make, and that the posts do not infringe the intellectual property right of any other person. Upon posting, the material included in that post becomes the property and intellectual property of Rainbow Dating.
Any reproduction or redistribution of the App or the Content is prohibited and may result in civil and criminal penalties. In addition, you must not copy the Content to any other server, location or educational for publication, reproduction or distribution is expressly prohibited.
All other use, copying or reproduction of the App, the Content or any part of it is prohibited, except to the extent permitted by law.
17. Warranties and Disclaimers
To the maximum extent permitted by law, including the ACL, we make no warranties or representations about the App or the Content, including but not limited to warranties or representations that they will be complete, accurate or up-to-date, that access will be uninterrupted or error-free or free from viruses, or that the App will be secure.
Subject to those rights that cannot be excluded under the ACL, our liability (and any third-party supplier's liability) for a breach of a non-excludable condition or warranty is limited, at our option, to the supply of equivalent services; the payment of the cost of replacing the or services or of acquiring equivalent services.
In no circumstances are we liable for any special, indirect or consequential loss, even if you advise us of any special circumstances or such loss was reasonably foreseeable.
You acknowledge that the App is intended to facilitate the interactions between different parties. We hold no liability to you as a result of any conduct of the parties or the misuse of your content by any party.
18. Indemnity
To the maximum extent permitted by law, you must indemnify us, and hold us harmless, against any liability suffered or incurred by us arising from or in connection with your use of the App or any breach of these Terms or any applicable laws by you. This indemnity is a continuing obligation, independent from the other obligations under these Terms, and continues after these Terms end. It is not necessary for us to suffer or incur any liability before enforcing a right of indemnity under these Terms.
You agree to release, indemnify and hold us and its officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including lawyers’ fees) arising out of or in connection with: (i) your use of the services; (ii) your breach or violation of any of these Terms; (iii) Rainbow Dating’ use of your Content; or (iv) your violation of the rights of any third party.
19. Events Beyond Control
Neither party shall be liable to the other party for any loss caused by any failure to observe the terms and conditions of this agreement, where such failure is occasioned by causes beyond its reasonable control including but not limited to by fire, flood, riot, strike, war, pandemic, restrictions and prohibitions or any other actions by any government or semi government authorities.
20. Termination
We may terminate or suspend your registration on the App at any time and we will not be responsible for any loss, cost, damage or liability that may arise as a result. Termination is effective the day notice is received, or such later date as specified in the notice. We may remove anyone from the system. You may cease using the App at any time.
21. Jurisdiction and governing law
Your use of the App and these Terms are governed by the law of Victoria and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria.
